Severe and Complex Personal Injury
Severe and Complex Personal Injury
Chip has handled a number of severe and complex personal injury cases. His team’s tenacious investigation of the facts surrounding a client’s tragedy sets Call & Gentry apart from other firms. Careful attention to detail, strategy, facts, and the law, together with a keen understanding of how the world works, important values, and ultimately holding responsible parties accountable serve as a recipe for success. Most importantly, Chip brings empathy, understanding and friendship into his client relationships.
Chip and the team at Call & Gentry obtained a $15,500,000.00 result for a young boy tragically injured when the car he was riding in collided with a semi- truck parked on the highway. 2nd Largest Missouri Settlement at the time.
Window & Door Litigation
Window & Door Litigation
He focuses much of his construction defect litigation in defending window and door manufacturers and others within the fenestration industry coast to coast. He handles multiple complex and large cases in several states at once.
Additionally, Chip routinely speaks nationally on critical and timely issues affecting the window and door industry including the Fenestration & Glazing Industry Alliance (f/k/a American Architectural Manufacturers Association), National Glass Association’s Glass Build America, Glazing Executives Forum, Northeast Window and Door Association, and MyGlass.com webinars. He also contributes articles for Glass Magazine and Window & Door Magazine.
Wage & Hour
Wage & Hour
Chip was one of the lead attorneys in a nationally recognized wage and hour class action, Fast v. Applebee’s International, Inc. Chip and his team represented over 5,600 servers and bartenders, Tipped Employees, that claimed Applebee’s failed to properly pay them wages by violating the “20% rule.” The employees claimed that they spent far more than 20% of their shifts performing non-tipped work or general preparation and maintenance. After a 6 year fight that involved many depositions in many different states, tens of thousands of documents, and an appeal to the U.S. Supreme Court and back, the case was successfully resolved. Chip and Call & Gentry Law Group are currently part of a team focused on helping employees obtain fair wages for fair work throughout the country.
Insurance Coverage & Bad Faith
Insurance Coverage & Bad Faith
Chip has also been involved in complex insurance coverage disputes involving millions of dollars, multiple layers of coverage, various triggering events, attachment points, contract interpretation, bad faith failure to defend, bad faith failure to settle, vexatious failure to pay, and agreements under 537.065 of the Missouri Revised Statutes to help insureds protect their personal assets when an insurer or insurers fail to properly defend insureds or to properly settle cases within policy limits. In one case where Chip’s client was not being appropriately protected by its insurance carriers, Chip helped protect the insured’s personal assets and the insurance carriers were required to pay approximately $55,000,000.
