The License Discipline Process
The fact that a complaint has been made against you does not mean that a Missouri state board will automatically impose discipline. Generally, a complaint triggers an initial investigation. You will likely be asked to respond in writing to the complaint. You may also be asked to voluntarily appear before the professional board for an “informal hearing” to answer questions and respond to allegations.
While these informal hearings may seem innocuous, they are often used as a means to gather evidence to be used against you in formal disciplinary actions. You have the right to be represented by an attorney at these informal hearings and you should be certain to do so by hiring an experienced attorney at the earliest opportunity.
If the state board believes there is cause to discipline your license, it may seek to resolve the case through a settlement agreement with you or it may file a formal complaint with the Administrative Hearing Commission (“AHC”). If action is brought against you before the AHC, your case will be set for an evidentiary hearing very similar to a court trial.
At the hearing, the state board will have the burden to prove that cause to discipline your license exists. If the AHC finds there is cause for discipline, your case will generally then be referred back to the state board for a determination of what discipline to impose. You may also appeal an adverse decision of the AHC or the licensing entity to the Circuit Court.
